TERMS OF SERVICES

1) ACCEPTANCE OF TERMS
Tozzenhower provides small business-to-business solutions  (referred to hereafter as “the Service”) which may include, but is not limited to Website development, business email, logo creation, domain name, business cards, HR services, Marketing services, TBOS services, Social Services, PR services, Social Media Management Services, Website Hosting services, Consulting services, Sales services, business development services, administrative services, and any other business solution services as needed by small businesses is subject to these Terms of Service (“TERMS”). By using the Service in any way, or by making any purchase on the www.tozzenhower.com website you are agreeing to comply with the TERMS. The terms, "we" and "our" as used in this Agreement refer to Tozzenhower.  We reserve the right to edit, change, or update these TERMS at any time without prior notification. You must review this agreement on a regular basis to keep yourself updated on any changes.  These TERMS are our “Legal Terms”.  Should you object to any term or condition of the TERMS, or become dissatisfied with the Service in any way, please immediately discontinue use of the Service.

2) DESCRIPTION OF SERVICES
Tozzenhower, Corp is a business solution provider. Our services encompass a wide variety of services, which greatly tailors and is custom made to best fit the customer’s needs. Tozzenhower’s staff is skilled in a variety of professional fields to serve diverse types of organizations. Our services allow companies to 1) discuss business needs and identify solutions necessary to fill the needs. 2) Receive a quote with all services listed. 3) Pay the service amount. 4) Service Delivery. 5) Service Review and validation. 

3) REGISTRATION
To register as a client, you must provide us with an email address and phone number to reach you. You must schedule an initial evaluation call to identify and establish all of your business needs. You must agree and accept the quote as provided and payment for services (refer to “DESCRIPTION OF SERVICES” to find definition of partial payment options.) All payments are received and processed via the tozzenhower.com online store. We do not accept any type of third party payments unspecified herein such as “Cashapp, Zelle”. 


4)  FEES/PAYMENT
If you elect to receive the Services you agree to pay the full amount as agreed for the Service.  We reserve the right to change our prices and at any time and without any prior notice. 

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment thereof. You agree to pay for any taxes that might be applicable to your use of the Service and payments you make to us.


5) CANCELLATION, REFUNDS, AND TERMINATION
If you cancel any of the SERVICES, your cancelation will take effect immediately. After cancelation, you will no longer have access to the specific service you have canceled. Tozzenhower reserves the right to fully refund a customer once the payment is received. We issue full refunds for services that have not been fulfilled or work that has not been started. If partial work has been completed, partial refund would be provided under the form of a credit memo. Tozzenhower keeps record of time spent on each project and depending on the nature of the project, prorated refund amounts are provided based on the allotted time spent on the project prior to the refund request. Full refund requests are not accepted past the ‘Delivery & Validation’ phase of the service cycle. Tozzenhower reserves the right to edit, adjust, modify, or completely end a client’s service or membership should the latter abuses, trespasses or illegally use any of our trademarks, logos, services, consultations, or representations unethically or illegally. Tozzenhower reserves the right to edit, adjust, modify, or completely end a client’s service or membership should the latter use our website or product solutions of any form and nature in shady transactions, false businesses, scamming, false identity businesses, misleading information or any type of illegal activity. Tozzenhower reserves the right to cancel a client’s membership or service should the service and/or project falls outside of our mission of statement. 6) LIMITATIONS ON SERVICE
You acknowledge that Tozzenhower may establish limits concerning use of the Service, including the maximum number of days that Content will be retained by the Service, the maximum number and size of postings, or other specific types of content that may be against the values of the Service, and the frequency with which you may access the Service or any of it’s employees. You acknowledge that Tozzenhower reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice, and that Tozzenhower shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.




7) Copyrights and Trademarks
Tozzenhower’s name and logo, may not be used in any way, without prior, written permission from Tozzenhower. Tozzenhower prohibits use of any logo of Tozzenhower or any of its affiliates as part of a link to or from any Website unless Tozzenhower approves such link in advance and in writing. No party should ever use our services for purposes other than those mentioned and agreed upon in the sales contract. 


8) No Guarantees, Warranties. Exclusion of Liability
Tozzenhower is operated without any guarantees or warranties of any kind. To the fullest extent permitted by law, Tozzenhower disclaims all warranties and conditions of any kind, including sales expectations, or any service you purchase from our website. Tozzenhower
shall not have any liability or responsibility for any errors or omissions in the content of our services or website, or for any damage to your business, or any other damage you may incur in connection with our services. Your use of our services are at your own risk. In no event shall Tozzenhower or any of its employees be liable for any damages incurred to you or your business.

9) Indemnification
You agree to defend, indemnify, and hold Tozzenhower harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of our Services or any website or Services you purchase through it.

10) Domain Registration
Domain registration services by Tozzenhower are provided through the domain provider, Google Domains. By agreeing to the TERMS, registrant also agrees to abide by the terms and conditions set forth by Google Domains available at: https://policies.google.com/terms


11) Website Services
Tozzenhower is an official reseller for Strikingly. Website Hosting services by Tozzenhower are provided through the website hosting provider, Strikingly. 12) Business Email Registration
Business Email services by Tozzenhower are provided through the Email hosting provider, Aplus.net. By agreeing to the TERMS, registrant also agrees to abide by the terms and conditions set forth by Aplus.net available at: https://www.deluxe.com/policy/terms-of-use
